Subject:- Taking up of long term as also short term consultancy assignments by Government servants on return from Study Leave etc – Consolidated Instructions on Foreign Assignment of Indian Experts – Clarification regarding.
I am directed to refer to Department of Personnel and Training’s O.M No.4/3/95-FA(UN) dated 23.8.96 (copy enclosed) on the subject mentioned above and to say that the existing instructions on the subject provide that an officer who has gone abroad on Study Leave or on Training should not be permitted to accept any foreign assignment/ consultancy abroad in continuation of the Study Leave or Training.
2. The question whether officers returning from Study Leave or Training abroad can be permitted to take up foreign assignments/ consultancies soon after their return was under consideration of the Government for quite sometime.
3. After careful consideration, it has been decided that officers who proceed abroad on Training or Study Leave should revert to their cadres and serve for at least two years before being eligible for undertaking foreign assignments/ consultancies.
4. The aforesaid decision of the Government may be brought to the notice of all concerned.

: Scheme for engagement of Consultants - Fixation of fee
of retired Government servants engaged as Consultants.
In
terms of this Department of this Department's O.M. No. 16012/7/97-Estt.
(Allowances) dated 13.02.1998, the ceiling of fee fixed in case of
retired Government Servants engaged as full-time Consultants is Rs.
13,000/- and for part-time Consultant is Rs. 6,500/- p.m.

Consequent upon the merger of 50% DA with basic pay w.e.f. 01.04.2004,
the question of increasing of ceiling of consultancy fee has been
under consideration by this Department, based on reference from various
quarters. IN partial modification of para 2(d) of the above said
O.M. relating to the amount of consultancy fee, it has been decided
in view of the decision of the Government to merge 50% DA with with
basic pay w.e.f. 01.04.2004, that for the Government Servants retired
on or after 30.04.2004 who are engaged as full time Consultants,
the fee will be fixed subject to a ceiling of Rs. 20,000/- p.m. They
will also draw their pension and relief thereon in addition. If the
Government Servants who retired on or after 30.04.2004 who are engaged
as full time Consultants, the fee will be fixed subject to a ceiling
of Rs. 20,000/- p.m. They will also draw their pension and relief
thereon in addition if the Government Servants who retired on or
after 30.04.2004 are engaged as part time Consultant, the fee will
be fixed subject to the ceiling of Rs. 10,000/- p.m. (without any
adjustment of the pension drawn by him). IN case any Ministry/Department
wishes to appoint any retired Government servants as a Consultants
at a fee higher than the limit prescribed, it should obtain the approval
of the Appointments Committee of the Cabinet by following the procedure
prescribed in this regard.

Ministries/Department are requested to ensure that the fee plus pension
plus dearness pension should not exceed the last pay drawn plus dearness
pay thereon.

The fee for Government servants who retired on or before 31.03.2004
and engaged as Consultants will remain Rs. 13000/- p.m. for full
time Consultant and Rs. 6500/- p.m. for part time Consultant, as
there was no element of Dearness pay prior to 01.04.2004.

These orders will take effect from The date of issue. The fee for
as Consultants prior to issue of this OM and whose Consultancy is
continued after issued of this OM with proper approval, may be refixed
w.e.f. the date of issue of this OM at revised rates.
6.
All other terms and conditions in the aforesaid guidelines will remain
same.
7.
So far as persons working in India Audit and Accounts Department
are concerned, these orders have been issued after consultation with
the Comptroller & Auditor General of India
